These Terms & Conditions (“Terms”) govern your access to and use of the Kraken Offroad website, including any subdomains, mobile experiences, and services (collectively, the “Site”), and any purchases of products such as off-road accessories, Jeep parts, mounts, brackets, racks, armor, lighting mounts, MOLLE panels, and related components (the “Products”). By accessing the Site or placing an order, you agree to be bound by these Terms.

If you do not agree, do not use the Site or purchase Products.

1) Definitions

  • “Kraken Offroad,” “we,” “us,” “our”: The operator of this Site and seller of Products.
  • “You,” “your,” “customer”: Any person or entity accessing the Site or purchasing Products.
  • “Content”: Text, images, designs, manuals, product descriptions, videos, reviews, and other materials on the Site.
  • “Vehicle”: Your Jeep Wrangler, Jeep Gladiator, or other off-road vehicle you intend to modify.
  • “Off-Road Use Only” means a Product is designed and marketed for use on trails, private land, and other off-highway environments, and is not intended, tested, certified, or approved for operation on public roads or highways. Any on-road use may be illegal in some jurisdictions and is solely your responsibility to evaluate and comply with.
  • “Off-Road Use” means operation of a vehicle on trails, private property, off-highway vehicle areas, or other non-public-road environments.
  • “On-Road Use” means operation of a vehicle on public roads, highways, and streets, including any environment subject to vehicle equipment, emissions, or roadworthiness regulations.

2) Eligibility & Account Responsibility

You must be at least the age of majority in your jurisdiction to purchase from the Site. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will change when we do. Your continued use of the Site after changes means you accept the updated Terms.

4) Product Use, Off-Road Disclaimer, and Assumption of Risk

Off-roading and vehicle modification are inherently risky. Our Products may be used in demanding environments including rock crawling, overlanding, trail riding, mud, snow, and high vibration conditions. You understand and agree:

  • You are responsible for safe vehicle operation, safe installation, and ongoing inspection/maintenance.
  • Modifying a vehicle can change handling, braking, rollover risk, and crash performance.
  • Improper installation or use can cause property damage, serious injury, or death.
  • OFF-ROAD USE ONLY: Unless explicitly stated otherwise, Kraken Offroad products are intended for off-road use only and are not designed or certified for on-road, highway, or street use.

You assume all risks related to installing and using Products, including use on public roads, trails, private land, and competition environments.

5) Fitment, Compatibility, and Customer Due Diligence

We do our best to provide accurate fitment information for Jeep models (including Wrangler JK/JL, Gladiator JT, and related trims), but vehicle configurations vary widely.

You are responsible for verifying:

  • Exact year/make/model/trim (and special editions).
  • Existing modifications (lift kits, bumpers, tire carriers, winches, aftermarket fenders, bed racks, roof racks, etc.).
  • Interference with sensors, cameras, airbags, ADAS features, and wiring.
  • Clearance for tires, suspension travel, doors, soft tops/hard tops, and accessory mounting points.
  • Products may affect vehicle safety systems and legal road compliance; verify applicable regulations and inspect regularly, especially after trail use.

Unless a Product listing explicitly guarantees compatibility with your exact configuration, fitment is not guaranteed. Any guidance we provide (by email, chat, phone, or social) is informational and not a binding guarantee.

6) Installation, Professional Help, and Safety

Unless otherwise stated, Products are intended for installation by experienced individuals. If you are not confident, use a qualified installer. You are responsible for:

  • Following included instructions and torque specs.
  • Using proper tools, fasteners, and threadlocker where appropriate.
  • Inspecting hardware after initial installation and periodically thereafter (especially after off-road use).

Some Products may require drilling, cutting, trimming, wiring, or other permanent modifications. You accept those risks.

7) Orders, Acceptance, and Cancellations

Order Acceptance

Your order is an offer to purchase. We may accept or decline an order at our discretion, including due to inventory limits, suspected fraud, pricing errors, or shipping constraints.

Cancellations

If you need to cancel, contact us immediately. Once an order has begun processing, been packed, or shipped, it may not be cancellable. If cancellation is still possible, it may be subject to processing fees (for example, non-reversible payment fees).

8) Pricing, Taxes, and Pricing Errors

Prices are shown in the currency displayed on the Site. Taxes, shipping, duties, brokerage fees, and other charges may apply depending on destination.

If a Product is listed with an incorrect price or incorrect information due to an error, we may cancel the order, refund you, and/or contact you for next steps. We are not obligated to honor incorrect pricing.

9) Payments, Fraud Prevention, and Chargebacks

We may use third-party payment processors. By purchasing, you authorize us (and our processors) to charge your payment method for your order total.

To protect customers and the off-road community from fraud, we may:

  • Request verification information (e.g., billing confirmation).
  • Cancel or hold orders flagged as high-risk.

Chargebacks (please contact us first): If anything about your order doesn’t look right, contact us before filing a chargeback—we can usually resolve issues quickly and often issue a refund immediately. Chargebacks are handled through banks and card networks and typically trigger non-refundable processing fees and administrative costs. If a chargeback is filed before you contact us, we may be unable to recover those fees even if we refund the order, and resolution may take significantly longer.

10) Shipping, Delivery, and Risk of Loss

Processing & Ship Times

Processing times may vary due to order volume, custom fabrication, quality checks, address verification, and carrier pickup schedules. We also use third-party logistics (“3PL”) fulfillment partners and multiple warehouse locations across the United States. Because inventory may ship from different facilities—and because 3PL processing and carrier handoff times can vary—shipment timing may differ from order to order.

If your store messaging includes a cutoff (example: “ships same day by 4PM EST”), that applies only when all of the following are true:

  • The item is in stock at the fulfilling warehouse,
  • The order is paid and verified (no fraud or address holds),
  • The order does not require customization, kitting, or special handling,
  • The order is placed on a business day (excluding holidays),
  • The fulfilling warehouse receives the order before the cutoff time in its local time zone (or as displayed at checkout), and
  • Carrier pickup occurs as scheduled.

Even when these conditions are met, same-day shipping is a goal, not a guarantee, and delays may occur due to warehouse processing, inventory transfers between locations, weather, system issues, carrier capacity, or other factors outside our control.

Addresses and Delivery Issues

You are responsible for entering a correct shipping address. If a package is returned due to an incorrect or incomplete address, you may be responsible for reshipping costs and any fees.

Risk of Loss

Risk of loss passes to you upon carrier acceptance (when the package is handed off to the shipping carrier), except where prohibited by law.

Lost, Stolen, or Damaged Packages

If a package is lost or damaged, contact us promptly. We may assist with claims, but carrier investigations take time and outcomes vary. If porch theft is a concern, ship to a secure location.

11) International Orders

International shipments may be subject to import duties, taxes, VAT, brokerage fees, and local restrictions. These charges are your responsibility unless explicitly stated otherwise. Delivery times are estimates and may be affected by customs processing.

12) Returns, Exchanges, and Restocking

We want you to end up with the right gear for your rig. Unless a Product page or written policy states otherwise, the following applies:

Return Eligibility (General)

Returns may be accepted if:

  • Requested within the return window stated on the Site (or within a reasonable period if not stated),
  • Items are new, unused, uninstalled, and in original packaging with all hardware/instructions,
  • Items are not final-sale or excluded.

Non-Returnable / Excluded Items (Common Examples)

The following are commonly non-returnable unless required by law:

  • Custom, made-to-order, or personalized items,
  • Items that have been installed, modified, drilled, cut, painted, powder coated, or damaged,
  • Electrical items once opened/installed (if applicable),
  • Clearance/final-sale items.

Restocking Fees

We may charge a restocking fee for returns (especially for opened packaging or returns not due to our error). Shipping costs are generally non-refundable unless the return is due to our error.

Return Shipping

Unless the return is due to our error, you are responsible for return shipping and ensuring items are packaged safely. We are not responsible for damage during return transit.

Exchanges

If exchanges are supported, we may treat them as a return + new order to keep inventory and shipping accurate.

13) Limited Warranty (Template Language)

Unless otherwise stated on a Product page or included warranty card, we provide the following limited warranty:

Warranty Coverage

We warrant that Products will be free from defects in materials and workmanship under normal intended use for a period stated on the Product page or documentation (or, if not stated, a reasonable limited period).

What This Warranty Does Not Cover

This warranty does not cover:

  • Normal wear and tear,
  • Cosmetic changes (scratches, chips, discoloration) from use,
  • Damage from improper installation, misuse, abuse, neglect, accidents, racing, or extreme impacts,
  • Corrosion due to environmental exposure, chemicals, road salt, or inadequate maintenance,
  • Modifications, welding, drilling, powder coating/painting after purchase,
  • Damage caused by other aftermarket parts or vehicle changes.

Warranty Claims

To submit a claim, contact us with:

  • Order number,
  • Photos/video of the issue,
  • Installation details,
  • Any relevant vehicle info (year, model, trim, and existing modifications).

We may, at our discretion:

  • Repair,
  • Replace,
  • Provide parts,
  • Or issue a refund for the purchase price of the affected Product (excluding labor and incidental costs).

No Labor Coverage

Unless explicitly stated in writing, the warranty does not cover labor, downtime, towing, storage fees, rental vehicles, or shop charges.

14) Disclaimers

EXCEPT AS EXPRESSLY STATED IN WRITING, THE SITE, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRAKEN OFFROAD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE PRODUCTS OR THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow limitations of liability for certain damages, so some of these limits may not apply.

16) Indemnification

You agree to indemnify, defend, and hold harmless Kraken Offroad from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Site or Products,
  • Your installation, operation, or modification of a vehicle using Products,
  • Your violation of these Terms,
  • Your violation of any law or third-party rights.

17) Intellectual Property

All Site Content, including product photos, copy, branding, designs, logos, and documentation, is owned by Kraken Offroad or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without written permission.

18) User Content (Reviews, Photos, Build Pics)

If you submit reviews, comments, images, videos, or other content, you grant Kraken Offroad a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, translate, adapt, and display that content for marketing and business purposes (including showing your Jeep build photos on product pages and social media), unless prohibited by law.

You represent you have the rights to what you submit and that it does not violate laws or third-party rights.

19) Prohibited Uses

You agree not to:

  • Use the Site for unlawful purposes,
  • Attempt to gain unauthorized access to systems or accounts,
  • Disrupt or interfere with Site security or operations,
  • Scrape or harvest data without permission,
  • Post false, misleading, defamatory, or infringing content,
  • Use the Site to distribute malware or spam.

20) Third-Party Links and Tools

The Site may link to third-party sites (installers, carriers, vehicle forums, payment tools). We do not control those sites and are not responsible for their content, policies, or practices.

21) Privacy

Your use of the Site is also governed by our Privacy Policy. Where these Terms and the Privacy Policy conflict, the Privacy Policy controls with respect to personal data.

22) Electronic Communications & Notices

By using the Site or contacting us electronically, you consent to receive communications electronically (email, SMS where applicable, and on-site notices), and such communications satisfy any legal requirement that they be in writing.

23) Governing Law

These Terms are governed by the laws of the state/province where Kraken Offroad is legally established, without regard to conflict-of-laws principles.

24) Dispute Resolution (Choose One: Court or Arbitration)

Arbitration + Class Action Waiver

Any dispute arising out of or relating to these Terms, the Site, or Products will be resolved by binding arbitration on an individual basis, and not as a class, representative, or collective action, except where prohibited by law. The arbitration will take place in the jurisdiction where Kraken Offroad is established unless the parties agree otherwise.

25) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

26) Entire Agreement

These Terms (and any policies referenced, including the Privacy Policy and Return/Warranty policies) constitute the entire agreement between you and Kraken Offroad regarding your use of the Site and purchase of Products, superseding prior communications.
